The Administrative & Local Government Law Section requests
authorization to file an amicus brief in GPS, Inc. v. Town of St.
Germain, currently before the Wisconsin Supreme Court.
At issue is whether proposed findings of fact and conclusions of law
regarding a zoning variance request drafted by a zoning appeals board's
attorney before any decision or vote by the board can be excluded from
public access based upon an attorney-client privilege.
The Section intends to support the Court of Appeals ruling upholding
application of the attorney-client privilege.
The Board of Governors will consider the request on Jan. 16, 2004.
Timely member input on whether the Section amicus should be authorized
