Author to Receive Wisconsin Lawyer Award for Exploring Wisconsin’s Castle Doctrine and Trespasser Liability Laws
Mark R. Hinkston, Creighton 1988 cum laude, is the 2013 recipient of the Hon. Charles Dunn Author Award, presented annually by the State Bar Communications Committee.
Hinkston is being honored for his article “Home Safe Home: Wisconsin’s Castle Doctrine and Trespasser Liability Laws” (June 2013). In selecting the article, the committee said, “Very well written with broad appeal, this article informs and entertains. Clear, cogent, and concise, Atty. Hinkston well-describes the previous state of self-defense law in Wisconsin and the changes brought about by the new legislation that is the subject of the article. Witty and entertaining, the author provides useful information on civil and criminal liability under the new laws and discusses the national impact of Castle Doctrine laws.”
Hinkston is affiliated with Knuteson, Hinkston & Quinn S.C., Racine. His practice is primarily devoted to business and construction litigation. The Dunn Award, named after Wisconsin’s first chief justice, recognizes writing excellence in Wisconsin Lawyer articles.

Attorney Laurence J. Dupuis for his article “DNA Extraction on Arrest: Maryland v. King and Wisconsin’s New Extraction Law” (Sept. 2013), which presents a thought-provoking, timely, and fascinating discussion of Wisconsin’s new law on DNA extraction, and the Maryland v. King U.S. Supreme Court case. DuPuis explains what DNA is in a way useful to lawyers and demystifies the process of how it is used in criminal cases. He also touches on the profound implications of taking and keeping DNA samples of those charged with, but not found guilty of, a crime.
Attorneys Daniel S. Davis, Mark J. Goldstein, and Coral Pleas for their article “Swimming Upstream: 20 Mistakes to Avoid When Starting Your Practice” (May 2013). This easy-to-read article has many useful tips for all attorneys, not just those starting their own practice. Based on the authors’ personal experience, the practice tips presented are worth their weight in gold. This article proves that a lawyer is never too old to learn something new.
Attorneys Meghan O’Connor and Diane M. Welsh for their article “Casting a Wider Net: Health Information Privacy Is Not Just for Health Lawyers” (Sept. 2013), dealing with who is required under HIPAA to keep health care information confidential and what kind of information is deemed confidential. Timely and useful to Wisconsin lawyers, it clearly and logically sets forth a cornucopia of useful information lawyers need to know when dealing with health care information.
Attorneys Paul G. Kent and Jordan K. Lamb for their article “Wisconsin’s Wetland Reform Act” (Feb. 2013), explaining the new law, the history behind it, and the current permitting process in fine scholarly fashion. Extremely well written, orderly, and concise, the authors bring alive what to most would be a very dry topic and make it interesting. This is a very useful and timely article for Wisconsin lawyers.

Col. John E. Kosobucki, Marquette 1977, was named Investigator of the Year FY 2013 for the Investigations of Senior Officials Directorate, Office of the Inspector General, Department of Defense, Alexandria, Va. He is retired from the U.S. Army.
