Government Immunity for
Safe Place Statute Violations

The court of appeals has published conflicting
decisions regarding whether governmental entities are immune
from liability under section 893.80(4) for violations of the
Safe Place Statute. Practitioners handling premises liability
cases involving governmental entities should be familiar with
the case law and consider how public policy factors affect their
