Final Order: CDC Eviction Moratorium Compliance for Eviction Filings
On Sept. 1, 2020, the Centers for Disease Control (CDC) issued an order entitled “Temporary Halt in Residential Evictions to Prevent the Further Spread of COVID-19.” The CDC order was published on Sept. 4, 2020, and remains in effect until Dec. 31, 2020.
On Sept. 21, 2020, Legal Action of Wisconsin and Wisconsin Judicare (Legal Action) requested an emergency order regarding the CDC order. On Sept. 23, 202, the Wisconsin Apartment Association and the Apartment Association of Southeastern Wisconsin Inc. (WAA/AASEW) also sought court guidance regarding the CDC order. The WAA/AASEW filed a supplemental request, to which Legal Action filed a response.
For reasons articulated in the court’s order, the court declines to adopt the proposed emergency order as proposed by Legal Action or with the additions proposed by the WAA/AASEW.
ORDER ISSUED: Oct. 21, 2020
DISPOSITION: Legal Action’s request is denied. No action is taken on the correspondence filed by the WAA/AASEW. All filings in this matter, including a copy of the CDC order, are public and available at https://www.wicourts.gov/covid19.htm.
