Mediation: What Young Lawyers Should Know

Young lawyers wanting to better serve their clients should become familiar with mediation, says Randy Westgate, Director of Mediation at Judicare Legal Aid.

Oct. 2, 2024 – Young lawyers wanting to better serve their clients should become familiar with mediation, says Randy Westgate, Director of Mediation at Judicare Legal Aid.

Westgate, a presenter at the State Bar's 2024 Young Lawyers Conference, discusses the shift from traditional advocacy to mediation, the role of mediators in client communication, and the growing significance of mediation in the legal system. He shares his journey into mediation and highlights the emotional aspects that lawyers must consider when resolving disputes.

"Mediation gives people the opportunity to understand their goals," says Westgate. By expanding the options available for dispute resolution, mediated agreements can increase the value for both parties. Unlike costly winner take all litigation, "winning [in mediation] is expanding the pie to achieve more."

    Key takeaways for young lawyers:

    • Understanding client needs is crucial in mediation.

    • Mediation expands the options available for dispute resolution.

    • Mediated agreements can increase the value for both parties.

    • Mediation can help deliver difficult news to clients.

    • Winning in mediation means achieving more for clients.
