The End of Deference? Tetra Tech, Loper Bright, and Judicial Review of Agency Decisions, discusses the evolving landscape of judicial review.
When Congress is silent or intentionally vague on a particular subject, what’s a judge to do? Wisconsin courts have had several years of practice in such cases thanks to the Wisconsin Supreme Court's 2018 decision in
Tetra Tech, which made Wisconsin a
Chevron-free zone six years before
Loper Bright. Whether you are a judge or a lawyer, gain a better understanding of the new normal and what the future holds for the deference doctrine.
Panelists include:
Former Chief Justice Patience Roggensack, Wisconsin Supreme Court (retired) has been outspoken on the issue. Roggensack wrote
a Law Review article published on the deference doctrine in 2006 years before
Tetra Tech and
Loper Bright. Current Wisconsin law related to this issue is based in large part on the portion of her opinion in
Tetra Tech.
Judge Shelley Gaylord, Dane County Circuit Court (retired) will provide a perspective and examples on how the bench handles decisions before and after
Tetra Tech.
Prof. James Speta, Northwestern Law School is a scholar who has written on this topic. Speta is author of an amicus brief in the
Loper Bright case, decided by the U.S. Supreme Court last year.
